Top India Stocks For 2014

Independent oil and gas firm Anadarko Petroleum Corp. (NYSE: APC)�on Sunday announced the sale of a 10% stake in a natural gas development block offshore of Mozambique to India�� state-controlled energy company ONGC Videsh for $2.64 billion in cash. Anadarko now owns 26.5% working interest in the project and is the operator.

The most interesting thing about this transaction is what Anadarko plans to do with the cash it gets from ONGC. The company said it plans to use the proceeds from the sale to ��ccelerate��development in its U.S. shale oil and liquids plays.

Anadarko is building its cash hoard, which totaled nearly $4.6 billion at the end of June, in order to develop its liquids plays in the United States. We noted last week in our report on companies spending the most to find oil that Anadarko plans to spend $5.5 billion this year to boost its U.S. oil production. This asset sale should help accomplish that, as well as giving the company some room to raise its anemic 0.8% dividend yield.

    HONG KONG (MarketWatch) -- Hong Kong stocks swung between small gains and losses early Thursday after hitting a seven-month high in the previous session, with the Hang Seng Index (HK:HSI) down less than 0.1%. Most mainland Chinese property developers outperformed the markets, with Guangzhou R&F Properties Co. (HK:2777) (GZUHF) rallying 3.4%, after the company reported a 44% month-on-month jump in sales for June. Shimao Property Holdings Ltd. (HK:0813) (SIOPF) climbed 2.6%, and China Resources Land Ltd.     Shares of Barnes & Noble (BKS) were falling before the close Thursday, on news that John Malone�� Liberty Media (LMCA) is selling most of its 17% stake in the bookseller.

    Liberty Media reached an agreement with Barnes & Noble to sell 90% holdings, which will result in the loss of one of its two board seats. The shares are being purchased by institutional investors, with the sale expected to close next week.

    As The Wall Street Journal reports, Liberty didn�� say how much it was selling the share for, but the move comes after Barnes & Noble has enjoyed a big rally, climbing 66% since February through yesterday�� close. A person close to the deal says that the price was higher than $250 million, which would give Liberty a good deal of profit, as it paid $204 million for the entire stake in 2011. It�� also been earning a fixed dividend on the preferred shares: The anonymous source pegs a return of more than20% on the investment.

Get used to market volatility

The CBOE Volatility Index, or the VIX, has ticked up in recent weeks as the economic picture becomes uncertain.

NEW YORK (CNNMoney) Buckle up investors, it looks like it's going to be a bumpy ride for stocks for the foreseeable future.

Big swings in the market have been a common theme already this year.

The CBOE Volatility Index (VIX), or VIX, is up nearly 15% so far in 2014. And CNNMoney's Fear and Greed Index, which tracks the VIX and six other gauges of investor sentiment, has been in Extreme Fear mode for more than a week. It may stay like this for a while.

"There's probably going to be a lot of up and downs in the next few months," said Anthony Valeri, an investment strategist with LPL Financial.

That's because investors are trying to get a sense of where the economy actually stands, said Brad McMillan of Commonwealth Financial Network. Weaker than-expected economic reports, including two straight months of tepid jobs growth, are upending the notion that the economy is picking up steam, he said.

And while unseasonably cold weather may be to blame, investors can't know for certain.

Then there's the Federal Reserve.

The central bank announced in December that it would start scaling back, or tapering, the size of its monthly bond purchases. The main reason for this was that the Fed felt that the recovery was sustaining momentum. But it's no longer a slam dunk that the Fed will taper again at its next meeting in March.

Turmoil in the emerging markets is only adding to the confusion for investors.

So how can investors protect themselves, or even profit from, these big swings?

Valeri urges investors to buy on the dips. "When you see these bouts of volatility, you should treat them as a buying opportunity," he said.

But McMillan sees it differently. His advice: sit tight.

"If you have a multi-year time frame, this is noise," he said. "More money has been lost trying to time the market than with market fluctuations."

There are also financial products designed to do well when the market goes haywire, but they're not for the faint of heart.

Todd Salamone of Schaeffers Research, an options trading advisory firm, encourages investors to study the ups and downs of individual stoc! ks rather than look at the overall market.

Options, which are contracts that give investors the right to buy or sell a stock at a specific price on or by a set date, typically thrive off volatility. For example, the price of certain kinds of options for companies that are rumored takeover targets will often spike well before the stock price moves.

Traditionally reserved for big time Wall Street players, options are now offered to individual investors by leading online brokers such as Charles Schwab (SCHW, Fortune 500), E*Trade (ETFC), and TD Ameritrade (AMTD).

But option trading is risky business, and definitely not for everyone. Large investment firms often use them to hedge their bets.

The most important thing: "know what you're buying, understand how it works," Salamone said.

Another tool: exchange-traded funds designed to perform well in times of volatility.

The CBOE Emerging Markets ETF Volatility (VXEEM), for example, tracks volatility in emerging markets companies. It's up more than 20% so far this year due to worries about the health of the so-called "Fragile Five" emerging markets.

But again, caution is urged before delving in, as investors can lose a lot of money should the markets smooth out and go about their regular business. To that end, this ETF plunged 7% on Thursday when the broader market rallied. And it fell another 3% Friday as stocks rose again.

IRA Rollovers Among Hot Areas for FINRA Scrutiny in 2014

The Financial Industry Regulatory Authority warned broker-dealers Thursday to prepare for heightened scrutiny this year in a host of areas, namely of their recommendations on IRA rollovers, private placements and complex products like nontraded REITs.

FINRA highlights in its exam priorities letter that it will also create this year a dedicated enforcement team under its High Risk Broker initiative to prosecute brokers who have a pattern of sales practice abuses. FINRA barred 16 such brokers in 2013.

Susan Axelrod, FINRA’s executive vice president of regulatory operations, encouraged firms to use the guidance “along with their own analysis” to enhance their compliance programs as FINRA “will be examining for strong controls and robust compliance efforts in these areas.”

Richard Ketchum, FINRA’s chairman and CEO, said in the same statement that by providing “detailed guidance to firms, we hope to not only support firms’ compliance efforts but also to alert firms to the issues we have identified as the most salient risks to investors and the integrity of our markets.”

FINRA notes that its areas of concern include conflicts of interest, fraud, how firms handle liquidity risk, and high-frequency and algorithmic trading, and that the self-regulator “will update its view on risks throughout the year.”

Cipperman Compliance Services notes that while FINRA’s exam priorities letter helps firms by highlighting FINRA’s new focus areas (interest-rate sensitive securities, recidivist brokers), “every year the list just gets longer because FINRA never really drops any of the old topics off the list (for example, anti-money laundering, customer data protection, conflicts of interest).”

Products to Watch

FINRA says that it will examine the suitability of recommendations to retail investors for complex products, which include structured products, like leveraged exchange-traded funds; interest-rate sensitive investments, like long-duration bond funds and muni securities; nontraded real estate investment trusts; frontier emerging-market funds; and mortgage-backed securities.

Qualified Plan Rollovers

FINRA also says that in 2014, reviewing firms’ qualified plan rollover practices will be an examination priority, and that staff will examine firms’ marketing materials and supervision in this area. FINRA will also evaluate securities recommendations made in rollover scenarios to determine whether they comply with suitability standards in FINRA Rule 2111.

In its just released Regulatory Notice 13-45, FINRA reminds firms of their responsibilities concerning IRA rollovers. FINRA said that it issued the December notice to remind firms of their responsibilities when recommending a rollover or transfer of assets in an employer-sponsored retirement plan to an IRA or marketing IRAs and associated services.

FINRA says that it shares the Government Accountability Office’s concerns that investors may be misled about the benefits of rolling over assets from a 401(k) plan to an IRA. In Regulatory Notice 13-23, FINRA warned against making claims of “free IRAs” or “no-fee IRAs” where investors do pay costs associated with these accounts.

Private Placements

FINRA says that it will not only be monitoring general solicitation and advertising of private placements under the recently adopted amendments to Rule 506 of Regulation D, but it will also assess the due diligence suitability of private placements. As part of the JOBS Act, which became law in 2012, retail investors will be allow to purchase unregistered securities offered through crowdfunding websites. However, to maintain investor protections, the Act limits the amount they can invest in a year based on their income and net worth. The SEC and FINRA proposed rules on Oct. 23, and comments are due by Feb. 3.

FINRA notes that the objective of its proposed rules is to ensure that the capital-raising objectives of the JOBS Act are advanced in a manner consistent with investor protection.

Until adoption of the SEC’s proposed rules, no JOBS Act crowdfunding is lawful.

FINRA notes that as its rules become effective, and funding portals become FINRA members, the self-regulator will implement a regulatory program designed to protect investors while recognizing the distinctions between funding portals and broker-dealers.

    If you take a look at the chart for Wendy's, you'll notice that this stock has been trending sideways and consolidating for the last two months, with shares moving between $8.11 on the downside and $8.88 on the upside. This consolidation has been occurring just above WEN's 50-day moving average of $8.23 a share. Shares of WEN are now starting to spike higher and move within range of triggering a major breakout trade above the upper-end of its recent range.

    Market players should now look for long-biased trades in WEN if it manages to break out above its 52-week high at $8.88 a share with high volume. Look for a sustained move or close above that level with volume that hits near or above its three-month average action of 6.61 million shares. If that breakout hits soon, then WEN will set up to enter new 52-week-high territory, which is bullish technical price action. Some possible upside targets of that breakout are $12 to $15 a share.

    Traders can look to buy WEN off weakness to anticipate that breakout and simply use a stop that sits right below its 50-day moving average at $8.23 a share, or below more support at $8.11 a share. One can also buy WEN off strength once it clears its 52-week high at $8.88 a share with volume and then simply use a stop that sits a comfortable percentage from your entry point.

Facebook Keeps Earnings Growth Coming, Share Price Follows

Facebook Inc. (NASDAQ: FB) released its third-quarter 2013 earnings report after markets closed on Wednesday. Sales rose by 60% year over year to $2.02 billion in the quarter. Adjusted earnings came in at $0.25 per share, versus $0.12 per share a year ago. Thomson Reuters was calling for the report to be $0.19 per share earnings and $1.91 billion in revenues.

Facebook investors are liking what they see this afternoon. We have broken out the main metrics that will drive most of the conversation on Thursday. The highlights are continued user growth, mobile ad growth, total revenue and income growth, solid cash balances, and more. Here are some highlights:

The non-GAAP operating margin rose sequentially from 44% to 49% and from 42% in the same period a year ago. Revenue from advertising totaled $1.80 billion, which is 89% of total revenue and is 66% higher than a year ago. Mobile advertising revenue was roughly 49% of advertising revenue for the third quarter, up sequentially from 41%. Payments and other fees revenue was $218 million for the quarter. Cash and marketable securities totaled $9.3 billion at the end of the quarter. Daily active users were 728 million on average in September. Monthly active users rose to 1.19 billion in the quarter, up 18% from a year earlier. Mobile monthly average users were up 45% to 874 million, while mobile daily average users were 507 million for September. Excluding share-based compensation and related payroll tax expenses, its expenses were up 45% from a year ago to $1.28 billion.

    Shares of Gilead (GILD) and Celgene (CELG) have tumbled today after both companies revealed that they were facing patent pressures.

    For Gilead, Idenix Pharmaceuticals (IDIX) filed a patent-infringement lawsuit that appears to target Gilead’s Sovaldi (someone please correct me if I’m wrong). For Celgene, it was the decision of a New Jersey court to schedule a hearing on a patent case for April 29, earlier than expected. It hasn’t helped that the UK’s National Institute for Health and Care Excellence also said that Celgene’s Revlimid doesn’t work well enough to be covered for “second line treatment of multiple myeloma.”

Top Retail Companies To Watch For 2014

Charles Schwab’s second quarter ETF Investor Snapshot, released Tuesday, reported that exchange-traded-fund assets custodied at the firm at the end of June reached $217 billion, a 30% increase over June 2013.

According to the report, second quarter ETF flows amounted to $5.2 billion, up 9% from the first quarter.

Equity funds represented 70% of the flows, well up from 25% in the first three months of the year. Of this, 39% went to U.S. equity and 31% to international equity.

Fixed income accounted for just 4% of ETF flows in the second quarter, a big drop from the previous quarter, which the report ascribed to large outflows from short-term bond funds.

The ETF Investor Shapshot is based on analysis of ETFs on the Charles Schwab platform, regardless of ETF or distributor.

The report said retail traders enrolled in Schwab Trading Services captured 11% of the ETF flows in the July 2013 to June 2014 period, up from just 6% in the previous year.

Shares of the leading used-car dealer fell by 4 percent on Friday, carrying over into another 4 percent loss on Monday. It wasn't a bad report -- Wall Street was just holding out for a better overall performance as sales and earnings fell short of expectations. CarMax's report offers a great glimpse into trends of the resale market, which tops the 16 million or so new cars sold every year. Let's go over a few things that CarMax was taught us this time around. CarMax's Model is Gaining Popularity Used-car salesmen used to have a shady reputation, but today's youth will probably have to stream a copy of "Used Cars," a 1980 film with Kurt Russell, to get that feeling. No longer do we automatically think of slick-talking salesmen trying to unload lemons. CarMax offers an experience that's a lot closer to new car showrooms with clean floors, massive selection and sales reps that don't necessarily have a hidden agenda because the cars are sold at haggle-free prices. CarMax claims that its market share has risen by 17 percent over the past year in terms of its core product of selling cars that are no more than 10 years old.
